Right. I'm a bit sick of asking the question "when/where is the bay ball", so if you have any information on it, please continue on. If you don't, post your sarcastic attempts at humour somewhere else please, I want ANSWERS, goddamit. 1. Is it on this year? 2. Who is organising it? 3. What time does it start? If the Bay Ball isnt on this year, then by God I am going to the East Sands anyway with a few beers, some firewood and a guitar, so please, if you don't want to attend the yah-fest that is the May Ball, feel free to come and join me.

To be honest, I was under the impression that no one really organised the Bay Ball, it just hapened, and people organised their own stuff. I seem to remember the first time it happened it was more like a chain reaction of suggestions that culminated in lots of people meeting int he same place for drinks. Bay Ball is the alternative to the May Ball, held usually on the same night for those who didn't get tickets for the May Ball or just prefer to celebrate in a less flashy and sycophantic way. It's held on the East Sands, people bring their own beer and sometimes stuff to chuck on the fires, and you just have a rollicking good time, as long as the po-lice don't turn up and ruin it (they won't this year, it was always perfectly legal to have a party on the beach, and fires too). So yeah, May 9th is May Ball, right? I'll be there when the sun goes down setting up the fire(s) and stuff. Anyone care to bring music?

It's perfectly legal to have a fire and alcohol on the beach, provided you're below the high water mark. Above the high water mark, and you're on public property, where alcohol and unauthorised fires are not permitted.

Try telling the MSHW mark rule to HM Finest Studentophobe Fife Joke Squad, and instead of catching real criminals in Glenrothes or other shambolic miseries, they'll probably bang you up for a breach of the peace. Or, if they're feeling creative, the Terrorism Act. Fife Police don't seem to care for the law. As I found out once when asking them for the written authorisation from HM Coastguard that I was disturbing shipping.

That would depend if the beach is included in the limits for the town by-laws, which Castle Sands isn't. So you can drink alcohol down there, as it isn't covered by the by-laws. Not sure about East Sands though. Don't take my word for it, however, as no legal expert am I.

From the Save Our Beach Bonfires Facebook group: I refer to the complaint that you submitted by e mail on 17 May regarding the conduct of the Police in connection with a bonfire gathering on the East Sands beach St Andrews on 5 May. I can confirm that so far as I am aware there are no byelaws in existence which apply to the East Sands beach St Andrews. The only interest that the Council has in the East Sands is as landowner. As landowner the Council can grant permission for groups to undertake activities on the beach. However, such permission is of no consequence if the Police consider that criminal activities are taking place. Your complaint relates to operational police matters rather than anything which would involve the Council as Police Authority . In my opinion you should pursue your complaint directly with the Police. The Depute Chief Constable has a remit to investigate complaints against the Police. Further to your e-mail in May concerning police action in relation to beach bonfires in the St. Andrews area, I am now in a position to respond. For several years, the precise history of which is elusive, Fife Council have required any person(s) wishing to hold beach parties on beaches anywhere in Fife to submit an application form. Generally, consent has been given subject to compliance with 12 standard conditions detailed on the application forms. Once permission has been granted, a copy is passed to the police for attention during the course of patrol. Such attention has been given to beach parties, with direct reference to the 12 standard conditions in terms of ensuring compliance. Until receiving your e-mail, along with several others, the question of the statutory authority for the application of the 12 standard conditions has simply never arisen. Having looked into this in conjunction with the Law & Administration Department of Fife Council, I can now confirm that there is in fact no statutory basis for the regulation of beach parties on any beach within Fife. In short, this means that the 12 standard conditions applied in respect of permissions have no legal authority and as such are not enforceable in their own right. That said, the application of the 12 standard conditions has always been with a view to ensuring that beach parties were conducted in an orderly manner, with due regard to other beach users and to the environment. I would stress that there has never been a deliberate attempt to disrupt beach parties for their own sake. Any police action taken has been taken with the interests of the wider public in mind. I can confirm that Fife Constabulary will no longer be involved in the direct enforcement of any non-statutory conditions relating to beach parties. However, this does not mean that the police will retreat form a position of ensuring that such events are run in an orderly fashion, with due regard to the safety and well being of individuals, enjoyment of the amenity provided by the beach to the wider public, and compliance with the law in relation to litter and other forms of nuisance including noise for example. Where there are complaints from members of the public regarding any aspect of a beach party which discloses a criminal offence, then appropriate action will of course be taken. I am pleased to note that these have been the exception in the past and the hope is that this will continue to be the case. Both the common law of Scotland and the provisions of the Land Reform (Scotland) Act 2003, make it clear that all members of the public have unrestricted access to beaches. However, such access is not unconditional and you will appreciate that such rights come with responsibilities. Further information on the Outdoor Access Code can be found at http://www.snh.org.uk/pdfs/access/KnowCode.pdf. The consumption of alcohol on any beaches in Fife is not an offence as the regulations which forbid the consumption of alcohol in public places does not extend to beaches. Again, the expectation is that people will behave responsibly in this regard, having regard to the personal safety of themselves and others, and to the environment by ensuring that all cans; bottles, packaging are removed from the beach at the conclusion of any party. Contact has already been made with the one individual who had been subject to a fixed penalty notice in this regard and this has now been rescinded. Clarification on the extent of coverage of the legislation has been provided to all police officers in St. Andrews. In closing, I would thank you for bringing this matter to our attention. The situation was one which had developed over a period of years without question, and police activity has been carried out with the best of intentions. I hope this information has clarified matters and we look forward to supporting the continued enjoyment of beaches in St. Andrews by the student population without incident. Yours Sincerely

After reading that I'm not entirely sure what the hell is legal and what isnt. However I did pick up that nobody will really care or not what I do, so that's where I'll be May 9th. As I said before, anybody is welcome to join me and the others who wander down onto the beach, if between now and then, nothing is organised, as looks likely. *Provided the weather isnt really shit.
