Traffic Offence

Does anyone know whether a traffic offence (running a red light) would class as a criminal conviction under the rehabilitation of offenders act 1974 or not?

They are convictions but they wouldn't necessarily appear on a criminal record. In England and Wales, minor traffic offences are generally not recordable unless you were arrested at the time. In Scotland, all traffic offences are recordable.

Hmmm...just wondering wheter i should declare it as an unspent conviction or not...

Did it go to court? A criminal conviction can only be passed by a bench, I think?

Oh... I didn't realise it would explode.
So someone asked me "What is it you do?". I thought about it for a minute. Then I thought about it a little more. All the while I probably looked like I was staring in to space, struggling for an answer. And I was. There was only one response I could really give.

I was given three points on my licence and a fine for speeding in Cumbria nearly three years back. Quite soon after I was applying to renew my firearms and shotgun certificates, I had to put that down on there as a conviction. I also thought that it had to go to court to count as a conviction but when I talked to my firearms officer he said no, it has to go on the application. By then I had already applied and the permits had been renewed and the Police hadn't noticed. ha! I was told not to do it again though (speed, or forget to put it on my application).

I know this comes down to semantic pendanticism, but a conviction should not be summarily handed out by one of HM finest rogues. It should rest with the justiciary...

When did it happen? That coupled with the severity determines whether or not it is spent under the ROA - at least it does for Disclosure purposes. The system automatically weeds convictions according to a formula.

Yes, I temped for them at one point. Kill me.

It was less than 5 years ago which I believe is the time for fines and thanks gealle [img]littleicons/yellowtounge.gif[/img]

Even a simple fine could still appear. If this is Basic disclosure, however, there's a good chance it won't at all. Only on Enhanced does absolutely everything get disclosed.

The nature of my job (Recruitment Manager for a charity providing social care) means that I read through people's disclosures on a very regular basis. If we've gone to the bother and expense of requesting one, it means that we're pretty keen to hire that person and the only reasons we would refuse to do so following disclosure would be

a) Something is uncovered that suggests the applicant is unsuitable to work with vulnerable people
b) It is apparent that the applicant has deliberatly falsified or neglected to inform us of stuff that should have been in their self-declaration.

Therefore, whilst I imagine that the job you're going for is probably quite different to the ones I recruit for, I'd still say that you're better safe than sorry. Mention the previous conviction on your self-declaration and gain brownie points from your potential employer for honesty. At the end of the day, unless the job requires a squeaky-clean driving license, they're probably not going to reject you on the basis of it.
