I recently bought a phone off a girl on the sinner. She assured me that it worked fine so I paid twenty quid. It didn't work at all.

At first I thought it must be a mistake on my part, so I took it to carphone warehouse. They told me that it would not work. I then believed that the girl, who i know vaguely, had been mistaken, and e-mailed her to ask for my money back (as I'm skint and had to fork out for a new phone- leaving me really broke).

The girl did not reply to my e-mail though, and deleted me as a friend on facebook. She still will not reply. I am desperately broke and need the money back.

What do I do? I didn't want there to be hard feelings and offered a compromise wherebyu |I only get fifteen quid back, but she didn't seem intersted. What doI do?

well i am a bit donfused by all of this as it was definately working when i sold it to you and i never had any problems like that with it, so am not sure why i should accept responsibility for it. am not a nasty person but like you i cant afford all this and i dont see why i should be stuck with a phone i am sure i didnt break

Don't know if a version exists in Scotland. But basically, a buyer has the right to ask for the money back if it proves that the condition of the item is not what it had been advertised.
Now if the seller can't pay the money back right now, I'd personally suggest that the buyer offers to pay the money back in full when he/she can, or at least in £5 deposits over 4 months or something.

Agreed, sounds like she scammed you out of the money. I don't know if you have any legal protection over the matter if it was just arranged on here but I'd definitely out her sinner name at least on here - if you don't then other people could fall for it too.

People who sell faulty stuff either know when they sell it or if it is an accident I know for sure I would be bending over backwards to give you your money back with a full apology. It's fairly easy to see if they are innocent or guilty when it comes to whether they'll give your money back.

in the uk the law is that if you buy second hand goods, you buy them 'as seen', therefore it is the buyer's responsibility to check that the item works correctly before they buy it, and they have no recourse to action should the item not work after the sale has been made. so basically, you're screwed

Unlesser the seller lied about the state of the goods, the seller claimed it worked perfectly so is this not a case of obtaining cash by decite, whic is either theft or froad.

Ask the police.

Actually, it's almost certainly neither theft nor fraud. A mobile phone was offered for sale and the buyer got a mobile phone. For there to be any illegality, the buyer would have to prove that the seller knowingly sold a phone that didn't work while presenting it as being in perfect working order. Even then it would more likely be a matter for the civil law and nothing to do with the police.
