Legally you can only consent to assault and battery so according the case of R V Brown & Others S&M is illegal (this was the group of blokes nailing their foreskins, fishook through scrotums case previously mentioned) as its abh/gbh. However in another case (cant remember the name and i cant be bothered to find my criminal law textbook) where the S&M was between a married couple as opposed to a group of gay men the judge ruled that consenting adults in a relationship can cosent to abh. Reviews has said this is discriminatory against gay men but a case to challenge this ruling has yet to come up (at least last year there were none)
The moral of this story; common law sucks and changes too often

ps. this probably only applies in England in Wales not sure how common law applies in Scotland therefore this post cn probably be ignored

This is probably a stupid question but how come in some cases the victim can choose whether to press charges or not but not in others? ie where is the boundary. Wouldn't the police at least need some kind of willingless on the part of the victim to prosecute, which there obviously wouldn't be in a case such as this when the victim wanted it done to them? I suppose the problem with letting people having the freedom to do what they want sexually is with the real extreme cases like that german cannibal. But then again, surely its better to kill someone that wants to be killed rather than someone who doesn't? I just realised that a discussion of cannibalism might not be the best thing here given that this club doesn't want to be banned...

Yeah, my father got freaked out when he saw that some schools have a pagan society, I can imagine that seeing bondage on the list wouldn't go over too well.

Maybe there should just be a society called SPS - Sexually Perverted Society, rather than setting up niche Societies. Such a Society would have greater appeal.

However don't ask me to write the constitution.

Be careful when volunteering for these slave auctions, that's how a lot of people were tricked into becoming real slaves in Roman times. You think it's just for a weekend - then end up nailed to a cross when you try and escape.

The R v Brown case was more complex than it is being made to appear. Perhaps it would be better to say that S&M is extra-legal. That is, it is not specifically illegal, but can be proseucted under ABH or GBH if it goes far enough and even under Common Assault. In the particular case here convictions were obtained on the basis of the parties' involved own statements - freely made to the police under the assumption that their actions were not illegal. The only subsequent prosecutions have been where consent was not present or where matters went a lot further than one or more parties anticipated and they therefore brought actions for assault. That is right and proper. No further cases have been prosecuted where all parties consented and no harm was done. So the sexual practice of S&M has not been criminalised, but certain things done under its banner can still lead to prosecution if those involved choose to pursue it.

I have to wonder just how it is that the police find out about these things? If it's people having hammered their genitals to the wall or such like turning up at A&E, it seems infinitely more logical to me to - rather than further the waste of tax payers money on prosecuting or deciding whether ot prosecutre, why not just present them with a bill for their use of hospital.

As has often be said, there are better things for the police to do than persecute the middle classes for what they do behind closed doors - like stop murderers and rapists, you know, the kind of things they used to do.

He must not have been looking too closely as there's a Pagan Society here at St Andrews...

I remember when its existence was "revealed" by The Sun some years ago - the article, as was usual at the time, began with a 1/2 page photo of Prince William. The classic bit, though, was the inset which had a "spooky" woman with green face paint and an elongated nose complete with wart. T'was a thing of great beauty.
